1. These terms apply to all our offers, contracts of sale,
transactions and deliveries.
2. All our database information and offers are strictly done
by Internet.
All data are confidential and are intended only for hiring
and selection purposes within your company. No claims may
be derived from the information supplied. Yyello Air and any
providers of information accept absolutely no liability for
the content of this site.
Your registration is free of obligations. We are not responsible
for misinformation, faults or other failures mentioned on the
by Internet mentioned information, specifications, instructions,
etc.
3. A transaction is effected after we have received the customer's
dated and signed (e-)orderform. Subsequently, the data stated
on this (e-)form count as proof of the contents of the transaction.
Orderforms will be accepted if send by telefax or e-mail.
With a dated and signed order by the (e-)orderform we mean the
mentioning of the pilots idents (PILT-numbers) and furthermore
your company name, your name, address, e-mail adress and the
number and expiry date of your creditcard and -company. All
online payments will be processed by a payment service provider.
We reserve the right to cancel an order without mentioning the
reason, or to demand you, prior to delivery, some conditions
as for example a security for the fulfilment of your liability
to pay.
4. All prices are in Euro's and including taxes (if applicable),
but excluding transport-, courier- and deliverycosts (when applicable).
This clause is suitable for deliveries all over the world. Should
the banks calculate for bankingcosts or change these costs,
we have the right to adjust these costs to you. As well as for
delivery and/or transportation costs.
5. Your payment will be effected immediately. We guarantee you
your privacy, all data will only be used for the processing
of your payment. We don't give your personal data to others.
6. Transport (if applicable) is at our risk until the moment
of delivery to you.
7. In case of arrears in payment we are entitled to collect
the debt by a debt collection agency, bailiff or lawyer. If
we haven't received payment on the day of delivering the article(s),
interest is from that day payable by you. The arrear interest
amounts the Dutch statutory interest. All extrajudicial costs
to be made by us are also charged to you.
8. All our offers, contracts of sale and transactions are subject
to Dutch law.
Matters of dispute with you will be brought before the Amsterdam
Court of Justice in Holland, which is the competent court in
these matters, to the exclusion of all other courts and authorities
unless this is barred bij legal provisions. After being informed
in writing of our intention to start a legal action before the
competent court of the Amsterdam district, you are entitled
to inform us in writing within 6 weeks of the announcement court
in order to settle the dispute. In default thereof we are entitled
to start the legal action in our announcement.
These terms have been drawn up and filed with the court registry
of the Amsterdam Court of Justice in the Dutch and English language.
